Please read the Termocelsius sales conditions below
1. The formalization of awards/orders to Termocelsius, Lda implies, on the part of the Customer, their full acceptance of these conditions, unless others are agreed in writing by both parties.
2. The technical characteristics, images, and drawings presented in the catalogs and quotes are merely indicative and are the sole responsibility of the brands and manufacturers themselves.
3. The deadlines for the delivery and completion of the requested works are given merely as an indication, unless expressly agreed between the parties for a specific deadline for delivery and/or completion of the work.
4. In the case of material that is not available in stock in our warehouses, the deadlines will always be communicated to the customer based on the information provided by the manufacturer.
5. Failure to comply with deadlines that are merely indicative or based on information from the manufacturer does not justify the cancellation of the order by the customer, nor does it serve as a basis for claiming any right to compensation from Termocelsius, Lda.
6. In the same way, Termocelsius, Lda, declines any liability for delay or delay in the supply of the goods, when this results from cases of force majeure or attributable to third parties.
7. The prices presented in this budget are valid for the work in question and quantities mentioned, and cannot be replicated for other situations.
8. Any price change or the impossibility of guaranteeing the price by factories and/or suppliers will be notified by us before any supply or installation, and the customer is responsible for the decision to keep or change the order, a decision that must take place within 5 business days after receiving the communication.
9. These prices are subject to the application of the VAT rate, in accordance with the current legal rate.
10. This proposal is valid for 30 days.
11. Until other conditions are agreed between the parties, our invoices must be paid promptly, by check or bank transfer.
12. The granting of credit depends on the approval of the management of Termocelsius, Lda, and cannot be attributed any responsibility for the refusal.
13. In the event of non-compliance by the customer with respect to the agreed payment deadlines, Termocelsius, Lda reserves the right to interrupt deliveries, complaints or orders in progress.
14. The warranty for the products supplied and installed by Termocelsius, Lda, presented in this budget, covers the following points:
14.1. Termocelsius, Lda guarantees the warranty against manufacturing defects in accordance with and as indicated by the brands sold.
14.2. The Termocelsius warranty consists of the free repair and replacement of parts recognized by us as defective, and other forms of warranty are excluded.
14.3. The replacement of defective parts will not extend the originally established warranty period, and the warranty will only be renewed at the point 14.1. when the equipment is completely replaced.
15. The warranty for the products supplied and installed by Termocelsius, Lda, is considered excluded in the following points:
15.1. Malfunction or malfunction due to interventions caused by unauthorized personnel.
15.2. Defects caused by anomalies in the electrical supply, hydraulic network, or external factors.
15.3. Use of replacement parts that are not original or not authorized by Termocelsius, Lda and/or manufacturer.
15.4. The reconfiguration of electronic equipment (WiFi systems, Routers and Mobile Phones) will be invoiced in the amount of technical assistance.
16. Requests for intervention under the warranty must be requested from the technical assistance services of Termocelsius, Lda.
16.1. Technical assistance and maintenance services are provided by authorized and accredited personnel from Termocelsius, Lda.
17. Termocelsius, Lda reserves the ownership of the merchandise until the obligations assumed by the customer are fully fulfilled, remaining the faithful depositary of the goods.
17.1. The ownership of the products supplied and installed by Termocelsius, Lda, is transferred to the customer when the price of the products is paid in full (Article 409 of the Civil Code).
18. Termocelsius, lda has an occupational safety and hygiene contract with Centro-K, occupational accident insurance, and civil liability insurance, being a safeguard for the company and above all for our clients.
19. Termocelsius, Lda is an IAPMEI certified SME, has a building permit no. 61509, certified by Certificate no. SAC-921/2016 for installation, repair, maintenance or technical assistance and dismantling of fixed refrigeration equipment, air conditioning and heat pumps containing fluorinated greenhouse gases in accordance with Regulation (EU) No. 517/2017, Executive Regulation (EU) 2015/2067 and with Decree-Law no. 56/2011, CAE 43222 for installations and air conditioning systems, certified suitability for professional installations Solares No. 09/SOL/12833 is an installation and maintenance technician certified under Decree -Law No. 56/2011 as TIM II No. TIM02760. Indoor air quality buildings 1549-A/2009, and complies with legal obligations in their activity.
20. Termocelsius, Lda, like its clients, unconditionally submit to the jurisdiction of the courts of Loulé, renouncing any other jurisdiction in the event of a dispute.
The personal data collected as part of the preparation of this proposal may be used to send commercial information about Termocelsius products or services, unless the data subject opposes such submission and in any type of dispute, dispute, complaint or audit in which Termocelsius Climatization Lda is carried out by any state or regulatory entity.
We undertake to comply with the obligation of confidentiality regarding personal data, as well as to adopt the necessary measures to prevent its alteration, loss, treatment or unauthorized access.
